r' <br />RESOLUTION 2008-17 <br />APPROVING PRELIMINARY PLAT FOR FRENCHMAN PLACE 1ST <br />ADDITION ON PROPERTY LOCATED AT THE NORTHWEST QUADRANT OF <br />EVERTON AVENUE NORTH AND FRENCHMAN ROAD (COUNTY ROAD 8) <br />WHEREAS, Pratt Development Inc. has requested approval of a preliminary plat to allow <br />construction on the 54.1 -acre property legally described as follows: <br />That part of the East Half of the Northwest Quarter of Section 19, <br />Township 31, Range 21, Washington County, Minnesota lying northerly <br />of the center line of the Highway. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Pratt Development Inc. for a preliminary plat, subject to the following <br />conditions: <br />1. A preliminary plat is approved in accordance with the preliminary phasing plan dated <br />February 22, 2008 and preliminary plat dated March 31, 2008, except as amended by <br />this resolution. <br />2. Approval is contingent upon City Council approval of a rezoning to R-5 for the <br />northern 25.3 -acre portion of the site. <br />3. Approval is contingent upon Everton Avenue being upgraded according to City <br />standards. The street improvement project should include a trail on one side of <br />Everton Avenue and a sidewalk on the other side. Prior to final plat approval, the <br />City and the developer must reach agreement on how the street improvements will be <br />financed and constructed. <br />4. The preliminary phasing plan is generally approved. The entire length of Rosemary <br />Way will be constructed with the first layer of bituminous prior to issuance of a <br />Certificate of Occupancy for the 2nd building in phase 3 or any building in phase 4. <br />5. The private drive extending from the adjacent Victor Gardens development shall be <br />extended through the site to connect back to Rosemary Way and a cross -access <br />agreement between the two developments must be established for these access points. <br />6. Sidewalks shall be constructed on both sides of Rosemary Way. <br />7. Prior to approval of a site plan for development of the 1st building in phase 3 or phase <br />4, the developer shall submit design guidelines and a material palette for phases 3 and <br />4 to ensure that those buildings are designed to be compatible with each other. <br />
