The developer shall submit final site plans, building elevations, street improvement <br />plans, utility plans, grading and drainage plans, landscaping and tree preservation <br />plans, lighting and signage plans along with the required land use applications for <br />each phase of the development. <br />9. Prior to final plat approval, the developer must comply with the following conditions: <br />a. The developer must obtain preliminary plat approval from Washington County <br />and comply with all conditions of plat approval. <br />b. The 3 proposed outlots must be either combined with the adjacent lots with <br />drainage and utility easements placed over the pond and wetland areas or they <br />shall be deeded to the City. <br />c. The existing conditions survey will need to be revised to show all encumbrances <br />on the site. <br />d. The developer must comply with all conditions outlined in the City Engineer's <br />memos dated April 17, 2008. <br />e. The developer must obtain all necessary stormwater management and WCA <br />permits from the City. <br />f. The developer shall obtain all necessary local, state, and federal permits. <br />g. The Applicant will need to obtain written approval from Xcel Energy for any <br />proposed encroachments in the easement area. <br />10. Prior to the release of the final plat for recording, the developer must comply with the <br />following conditions. <br />a. Park dedication will be due for Lot 1, Block 1 and Lots 1 and 2, Block 2 for the <br />first phase of the development. The Applicant shall pay a park dedication fee in <br />lieu of dedicating land (9.3 net acres X $2,400 = $22,320). Park dedication for <br />the remaining lots and outlots will be due with the final plat for the subsequent <br />phases. Park dedication shall be subject to the fees in place at the time of release <br />of the final plat. <br />b. The applicant shall pay their portion of the Everton Avenue Study AUAR costs, <br />based on the net area of the project site (est. $17,695.99). <br />c. A development agreement will need to be signed and executed in a form <br />satisfactory to the City. <br />
