CITY OF HUGO <br />RESOLUTION 2008-30 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR VICTOR <br />GARDENS NORTH VILLAGE 5TH ADDITION ON PROPERTY LOCATED NORTH <br />OF ROSEMARY WAY AND EAST OF ELMCREST AVENUE NORTH. <br />WHEREAS, the Rottlund Company, Inc. has requested approval of a final plat for <br />"Victor Gardens North Village 5" Addition" to allow the construction of 8 courtyard <br />townhome units and 2 outlots on the 12.74 -acre property legally described as follows: <br />Outlot A, Victor Gardens North Village 2id Addition. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by the Rottlund Company, Inc. for a final plat, and; <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; subject to the following conditions: <br />1. A Final Plat is approved to allow construction of 8 multi -family units, in accordance <br />with the overall grading, utility and paving plans dated April 21, 2008 and the final <br />plat graphics dated May 7, 2008, except as amended by this resolution. <br />2. The Final Plat shall be subject to the PUD Amendment and Preliminary Plat <br />approvals (Resolutions # 2008-12 and #2008-13) granted by the City Council on May <br />5, 2008, except as amended by this resolution. <br />3. Development standards shall be as approved in the Victor Gardens PUD concept <br />approvals (Resolution #200047) and Victor Gardens North PUD approvals <br />(Resolutions #2005-05 and #2005-06). <br />4. Approval is contingent upon City Council approval of the vacation of the existing <br />drainage and utility easement over the subject property. <br />5. Park dedication requirements for this site have been met with previous additions. No <br />additional park dedication is required for this phase. <br />
