RESOLUTION 2007-25 <br />APPROVING A PUD AMENDMENT FOR UNITED PROPERTIES <br />INVESTMENT LLC FOR "VICTOR GARDENS NORTH VILLAGE 4TH <br />ADDITION" ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD <br />(COUNTY ROAD 8) AND EAST OF VICTOR HUGO BOULEVARD <br />WHEREAS, United Properties Investment LLC has requested approval of a PUD <br />amendment to allow construction of a restaurant and bank on the property legally <br />described as follows: <br />Lot 1, Block 1 and Outlot B, Victor Gardens North Village, according to <br />the plat thereof on record in the County of Washington, State of <br />Minnesota. <br />WHEREAS, the Planning Commission has reviewed the PUD amendment at a duly <br />called Public Hearing and recommends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by United Properties Investment LLC for a PUD amendment, subject to the <br />following conditions: <br />1. A PUD amendment is approved to allow the construction of a 4,910 -square foot bank <br />and a 8,100 -square foot restaurant on lots to be created in accordance with the <br />preliminary plat/PUD submittal received by the City on February 23, 2007, and <br />revisions received on April 11, April 23 and May 1, 2007, except as amended by this <br />resolution. <br />2. Approval is contingent upon City Council approval of the requested preliminary plat. <br />3. The development shall be consistent with the Victor Gardens PUD concept plan <br />approvals (Resolution # 2000-47), except as otherwise noted herein. <br />4. Development standards for the PUD shall be as indicated on the plans dated April 11, <br />2007 and revisions dated April 23, 2007 and May 1, 2007, except as amended by this <br />resolution. <br />5. The bank and restaurant buildings shall comply with the setbacks shown on the plans. <br />6. All commercial buildings must be sprinklered. <br />7. PUD flexibility is permitted for a 9.5 -foot encroachment upon the 30 -foot rear yard <br />(north lot line) setback requirement for the restaurant. <br />8. PUD flexibility is granted to allow shared parking and a reduction in the total number <br />of stalls required on site from 475 to 339 (4.11 stalls per 1,000 square feet). <br />a.
