RESOLUTION 2007-26 <br />APPROVING PRELIMINARY PLAT FOR UNITED PROPERTIES <br />INVESTMENT LLC FOR "VICTOR GARDENS NORTH VILLAGE 4M <br />ADDITION" ON PROPERTY LOCATED NORTH OF FRENCHMAN ROAD <br />(COUNTY ROAD 8) AND EAST OF VICTOR HUGO BOULEVARD <br />WHEREAS, United Properties Investment LLC has requested approval of a preliminary <br />plat to allow the creation of 3 lots on the 10.54 -acre property legally described as follows: <br />Lot 1, Block I and Outlot B, Victor Gardens North Village, according to <br />the plat thereof on record in the County of Washington, State of <br />Minnesota. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by United Properties Investment LLC for a preliminary plat, subject to the <br />following conditions: <br />1. A preliminary plat is approved to allow the creation of 3 lots, in accordance with the <br />preliminary plat submittal received by the City on February 23, 2007, and revisions <br />received on April 11, April 23 and May 1, 2007, except as amended by this <br />resolution. <br />2. Approval is contingent upon the City Council approval of the requested PUD <br />amendment. <br />3. Development standards shall be as approved as part of the PUD. <br />4. Park dedication requirements for this site have been met with previous additions. No <br />additional park dedication is required for this phase. <br />5. The developer must obtain all necessary permits from the City. <br />6. The development shall comply with the Fire Chief s requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane <br />signage. <br />7. The developer must comply with all conditions outlined in the City Engineer's memo <br />dated May 2, 2007: <br />a. The owner of Lot 2 will need to enter into a License Agreement with the City to <br />allow the deck within the drainage and utility easement. <br />
