P <br />Af <br />RESOLUTION 2006-15 <br />APPROVING A PUD AMENDMENT FOR POA-SCHERER, LLC. FOR <br />"VICTOR GARDENS 6m ADDITION" <br />WHEREAS, POA -Scherer, LLC. has requested approval of a PUD Amendment to allow <br />construction of 60 single-family units on property legally described as follows: i. <br />Outlot E, Victor Gardens East. <br />WHEREAS, the Planning Commission has reviewed the PUD amendment for the <br />community activity center at a duly called Public Hearing and recommends approval, <br />and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it shQuld and hereby does approve the <br />request by POA -Scherer, LLC. for a PUD general plan amendment, subject to the <br />following conditions: <br />1. A PUD amendment is approved to allow the creation of 60 single-family lots and 6 <br />outlots in accordance with the plans received on January 12, 2006 and on February 13 <br />2006, except as amended by this resolution. <br />2. The approval is contingent upon City Council approval of the Preliminary Plat. <br />3. The PUD amendment is approved based on the finding that the proposed project is <br />consistent with the City's Comprehensive Plan and the approved Victor Gardens <br />PUD. <br />4. Private driveways in front of the homes shall be a minimum of 22 feet long to <br />accommodate parking. <br />5. All cul-de-sac streets shall be at least 26 feet wide, face to face, with parking <br />permitted on one side, as shown on the plans. <br />6. Sidewalks are required along both sides of all public streets, except the cul-de-sacs. <br />7. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan for <br />review and approval by the City. <br />8. The developer and/or the owner's association shall be responsible for maintenance of <br />the landscaping and irrigation systems within the development. <br />9. The homeowner's association documents shall include language to ensure that the <br />enclosed garage spaces are maintained for vehicle parking and that parking of <br />snowmobiles, boats, RVs and other recreational vehicles in the driveway is <br />discouraged. The covenants shall be drafted to prohibit the storage.of anything in the <br />
