RESOLUTION 2006 -19 <br />APPROVING A PUD GENERAL PLAN FOR POA-SCHERER, LLC. FOR "VICTOR <br />GARDENS NORTH 3`d ADDITION" ON PROPERTY LOCATED NORTH OF <br />FRENCHMAN ROAD (CR8) AND EAST OF ELMCREST AVENUE NORTH <br />WHEREAS, POA -Scherer, LLC has requested approval of a PUD General Plan to allow <br />construction of approximately 16,000 square feet of commercial on the 7.84 -acre property <br />legally described as follows: <br />Outlot A, Victor Gardens North Village, Washington County, Minnesota. <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called <br />Public Hearing and recommends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA -Scherer, <br />LLC for a PUD general plan, subject to the following conditions: <br />1. A PUD general plan/site plan is approved to allow the creation 1 commercial lot for a <br />gas/convenience store and 1 outlot in accordance with the plans and application received by <br />the City on January 26, 2006, and revised on April 4, 2006, except as amended by this <br />resolution. <br />2. Approval is contingent upon City Council approval of the requested preliminary plat. <br />3. The development shall be consistent with the Victor Gardens PUD concept plan approvals <br />(Resolution # 2000-47), except as otherwise noted herein. <br />4. Development standards for the PUD shall be as indicated on the plans and graphics dated <br />April 4, 2006, except as amended by this resolution. <br />5. All platted commercial lots shall comply with the following setbacks: <br />Front yard (from public street) <br />15 feet <br />Between buildings <br />20 feet <br />Setback around the perimeter of the site <br />(exterior property lines <br />30 feet <br />6. The gas station and car wash shall comply with the setbacks as shown -on the plans. <br />7. PUD flexibility is granted to allow 24-hour operation of the gas station and car wash. <br />8. All commercial buildings must be sprinklered. <br />
