Resolution 2006-19 <br />Page 6 • <br />a. The existing drainage and utility easement over the outlot shall be vacated. <br />13. Prior to issuance of building permits, the applicant must comply with the following <br />conditions: <br />a. The applicant shall provide copies of the development covenants for City review. A copy <br />of the covenants shall be filed with the final plat. <br />b. The association documents shall include language to ensure that the tenant are <br />responsible for litter control from the premises and litter control is to occur on a daily <br />basis. <br />c. The association documents shall be drafted to prohibit the outside sale or storage of <br />merchandise, vehicles, equipment, or other items. <br />d. The developer shall submit association or covenant documents for review and approval <br />by the City attorney. <br />e. The developer's architectural control committee (ARC) shall review and approve all <br />building designs for compliance with this resolution, prior to building permit submittal. <br />A written copy of the ARC approval shall be submitted with the building permit <br />application for each building. The City shall review the building architecture for <br />compliance with the approved plans prior to issuance of building permits. <br />f. The applicant shall obtain all necessary local, state, and federal permits. <br />14. Site plan approval is required for the commercial development planned for Outlot A, Victor <br />Gardens North Village 3"d Addition. No development approvals are granted or implied. <br />15. Commercial development on Outlot A shall comply with all conditions of the Victor Gardens <br />PUD approvals. <br />ADOPTED by the City Council this 1 st day of May 2006 <br />Mayor <br />ATTEST: - <br />Mary reager, City Cler <br />
