RESOLUTION 2006 - 21 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POA- <br />SCHERER, LLC. FOR "VICTOR GARDENS NORTH 3'd ADDITION" ON PROPERTY <br />LOCATED NORTH OF FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF <br />ELMCREST AVENUE NORTH <br />WHEREAS, POA -Scherer, LLC. has requested approval of a final plat to allow construction of <br />one commercial lot and one outlot on the 7.84 -acre property legally described as follows: <br />Outlot A, Victor Gardens North Village, Washington County, Minnesota. <br />WHEREAS, the City has prepared a development agreement covering the improvements related <br />to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA- <br />SCHERER, LLC for a final plat; and <br />FURTHER, that the development agreement for said plat be approved, and that the Mayor and <br />City Administrator be authorized to execute the development agreement on behalf of the City; <br />and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />A final plat is approved to allow the creation of one commercial lot and one outlot in <br />accordance with the plans and application received by the City on April 12, 2006, except as <br />amended by this resolution. <br />2. Approval of the final plat is contingent upon approval of the vacation of the drainage and <br />utility easement over Outlot A, Victor Gardens North Village. <br />3. The developer agreement must be executed by the developer and the City prior to release of <br />the final plat <br />4. Development standards shall be according to the PUD general plan and preliminary plat <br />approvals granted by the City Council on May 1, 2006, and as may be amended. <br />5. Park dedication requirements for this site have been met with previous additions. No <br />additional park dedication is required for this phase. <br />6. The development shall comply with the Fire Chief s requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane signage. <br />7. The developer must comply with all conditions outlined in the City Engineer's memo dated <br />April 24, 2006. <br />
