RESOLUTION 2006 - 27 <br />APPROVING A PUD AMENDMENT FOR POA-SCHERER, LLC. FOR <br />"VICTOR GARDENS 5m ADDITION" <br />WHEREAS, POA -Scherer, LLC. has requested approval of a PUD Amendment to allow <br />construction of 7 townhome units on property legally described as follows: <br />Outlot B, Victor Gardens 2"d Addition. <br />WHEREAS, the Planning Commission has reviewed the PUD amendment for the <br />community activity center at a duly called Public Hearing and recommends approval, <br />and; <br />NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by POA -Scherer, LLC. for a PUD general plan amendment, subject to the <br />following conditions: <br />1. A PUD amendment is approved to allow the creation of 7 townhome units on 2 condo <br />lots, 1 lot for the pool/community center and 1 outlot in accordance with the plans <br />received on December 12, 2005 and on February 2 2006, except as amended by this <br />resolution. <br />2. The approval is contingent upon City Council approval of the Preliminary Plat. <br />3. The PUD amendment is approved based on the finding that the proposed project is <br />consistent with the City's Comprehensive Plan and the approved Victor Gardens <br />PUD. <br />4. The plans shall be revised to identify the location of the mailboxes for the <br />townhomes. The mailboxes must be architecturally compatible with the homes in the <br />development. The applicant must submit final plans for review and approval by the <br />City. <br />5. Cross access and maintenance agreements shall be recorded with the final plat for the <br />shared private street and parking. <br />6. Private driveways in front of the townhome garages shall be a minimum of 22 feet <br />long to accommodate parking. <br />7. The shared private street shall be at least 22 feet wide, face to face. No parking is <br />permitted on the shared private street. <br />8. Sidewalks are required along both sides of all public streets. <br />9. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan for <br />review and approval by the City. <br />
