RESOLUTION 2006-29 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PULTE HOMES FOR WATERS EDGE SOUTH FOURTH ADDITION WHEREAS, Pulte Homes has requested approval of a Final Plat for "Waters Edge South Fourth Addition" on property legally described as follows: Outlot B, Waters Edge South, Washington County, Minnesota according to the recorded plat thereof WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for Pulte Homes for Waters Edge South Fourth Addition; and FURTHER, that the development agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; subject to the following conditions: 1. A final plat is approved to allow the construction of 66 Courtyard townhome units, in accordance with the plans received by the City on April 7, 2006 and revisions received on May 1, 2006 except as amended by this resolution. 2. The development agreement must be executed by the developer and the City prior to release of the final plat. 3. Development standards shall be according to the PUD general plan and preliminary plat approvals granted by the City Council on May 17, 2004 and as may be amended. (Resolution 2004-33, Resolution 2004-34 and Ordinance 2004- 391). 4. The following conditions shall be met prior to release of the final plat for filing: a) The town homes shall be subject to the architectural controls that were created for the development and previously approved by the City. No adjacent townhome buildings shall have the same front elevations colors or architectural styles. Materials and colors of the town homes shall be consistent with the architectural plans and design palette as approved by the overall PUD and received by the City on May 4, 2006. b) HOA documents or written confirmation that the townhomes will be covered under the HOA established by the previous phases of this development must be submitted to the City Attorney for review and approval.
