RESOLUTION 2006-29 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PULTE <br />HOMES FOR WATERS EDGE SOUTH FOURTH ADDITION <br />WHEREAS, Pulte Homes has requested approval of a Final Plat for "Waters Edge South <br />Fourth Addition" on property legally described as follows: <br />Outlot B, Waters Edge South, Washington County, Minnesota according to the <br />recorded plat thereof <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Pulte Homes for Waters Edge South Fourth Addition; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; subject to the following conditions: <br />1. A final plat is approved to allow the construction of 66 Courtyard townhome <br />units, in accordance with the plans received by the City on April 7, 2006 and <br />revisions received on May 1, 2006 except as amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior <br />to release of the final plat. <br />3. Development standards shall be according to the PUD general plan and <br />preliminary plat approvals granted by the City Council on May 17, 2004 and as <br />may be amended. (Resolution 2004-33, Resolution 2004-34 and Ordinance 2004- <br />391). <br />4. The following conditions shall be met prior to release of the final plat for filing: <br />a) The town homes shall be subject to the architectural controls that were created <br />for the development and previously approved by the City. No adjacent <br />townhome buildings shall have the same front elevations colors or <br />architectural styles. Materials and colors of the town homes shall be <br />consistent with the architectural plans and design palette as approved by the <br />overall PUD and received by the City on May 4, 2006. <br />b) HOA documents or written confirmation that the townhomes will be covered <br />under the HOA established by the previous phases of this development must <br />be submitted to the City Attorney for review and approval. <br />
