Resolution 2006-29 <br />Page 2 <br />c) The HOA documents shall include language stating that maintenance and any <br />necessary repairs of the private drives, including repairs needed as a result of <br />public infrastructure projects, shall be the responsibility of the HOA. <br />d) The HOA shall be responsible for maintenance of sidewalks within the <br />development. <br />e) The covenants for this development should include language to make <br />homeowners aware that the land west of this development is zoned <br />agriculture, is not planned to urbanize and will include noises, odors and <br />activities consistent with rural development. <br />f) Cross access and maintenance agreements as well as drainage and utility <br />easements shall be recorded with the final plat for all private drives. <br />g) Park dedication shall be cash in lieu of land dedication for the 66 units in this <br />phase. Park dedication shall be due based on the park dedication ordinance at <br />the time the final plat is released for filing at Washington County. <br />11. The following conditions must be met prior to issuance of building permits: <br />a) The final plat, development agreement and associated documents must be <br />recorded at the County. <br />b) No changes shall be made to the HOA documents unless approved by the City <br />of Hugo in writing. Any amendments to the HOA documents must be filed at <br />Washington County. <br />c) The lighting fixtures type shall be the same style as was provided with the first <br />phase of this development. <br />d) The minimum floor elevations shall comply with Section 1175-060.1 of the <br />Hugo Zoning Ordinance. <br />e) The development shall comply with the Fire Chief's requirement regarding <br />fire flow calculations, the location of fire hydrants, fire department <br />connections and fire lane signage. <br />f) A site plan shall be submitted for review and verification of setback <br />requirements and approval by City staff. <br />g) All platted residential lots shall comply with the following setbacks: <br />Minimum lot width traditional homes <br />70 feet <br />Minimum front yard setbacks (from <br />25 feet <br />public right-of-way or private drive <br />curb <br />
