t <br />.11 <br />RESOLUTION 2006-31 <br />APPROVING FINAL PLAT, FINAL PUD PLAN AND DEVELOPMENT AGREEMENT <br />FOR POA SCHERER, LLC. FOR "VICTOR GARDENS 6m ADDITION" ON <br />PROPERTY LOCATED SOUTH OF VICTOR GARDENS 4tb ADDITION AND EAST <br />OF VICTOR GARDENS EAST <br />WHEREAS, POA Scherer, LLC. has requested approval of a Final Plat and Final PUD Plan for <br />"Victor Gardens 6h Addition" to allow the construction of 60 homes and 6 outlot on the 44.23 - <br />acre property legally described as follows: <br />Outlot E, Victor Gardens East <br />WHEREAS, the City has prepared a development agreement covering the improvements related <br />to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the final plat and final PUD <br />plan for POA Scherer, LLC for Victor Gardens 6`h Addition; and I ` <br />FURTHER, that the development agreement for said final plat be approved, and that the Mayor <br />and City Administrator be authorized to execute the development agreement on behalf of the <br />City; subject to the following conditions: <br />1. A final plat is approved to allow the construction of 60 single-family units, in accordance <br />with the approved preliminary plat dated March 8, 2006 and the plans received by the City <br />on January 12 and February 13, 2006 except as amended by this resolution. <br />2. The Final Plat shall be subject to the Preliminary Plat and PUD Amendment approval granted <br />by the City Council on March 20, 2006 and as may be amended. (Resolution # 2006-15). <br />3. The applicant shall comply with all conditions of PUD concept plan approval (Resolution <br />#2000-47) and the original development agreement dated June 6, 2002. <br />4. The applicant shall comply with all conditions in the City Engineer's letter dated May 30, <br />2006. <br />5. Outlots C -F shall be owned and maintained by the Homeowners Association. The purpose, <br />ownership and maintenance of the outlots created by this plat shall be as follows: <br />a. Outlot A contains the center island for the Provence Way cul-de-sac, is intended to be <br />utilized for private recreational purposes and will be owned and maintained by the <br />homeowner's association. <br />b. Outlot B contains the center island for the Flora Way cul-de-sac, is intended to be utilized <br />for private recreational purposes and will be owned and maintained by the homeowner's <br />association. <br />
