RESOLUTION 200647 <br />APPROVING PRELIMINARY PLAT FOR POA-SCHERER, LLC. FOR "VICTOR <br />GARDENS NORTH 4'h ADDITION" ON PROPERTY LOCATED NORTH OF <br />FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF ELMCREST AVENUE <br />NORTH <br />WHEREAS, POA -Scherer, LLC. has requested approval of a preliminary plat to allow <br />construction of one commercial lot and one outlot on the 5.88 -acre properly legally described as <br />follows: <br />Outlot A, Victor Gardens North Village 3"d Addition, Washington County, Minnesota. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public <br />Hearing and recommends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF HUGO, MINNESOTA, that it should and hereby does approve the request by POA- <br />SCHERER, LLC for a preliminary plat, subject to the following conditions: <br />1. A preliminary plat is approved to allow the creation of one commercial lot and one outlot in <br />accordance with the application and plans received by the City on June 29, 2006 and <br />revisions received on July 24, 2006, except as amended by this resolution. <br />2. Approval is contingent upon the City Council approval of the requested PUD General Plan. <br />3. Development standards shall be as approved as part of the PUD General Plan. <br />4. The preliminary plat shall be revised to correctly identify Frenchmen Road as CSAH 8. <br />5. No undevelopable outlots shall be platted. Outlot A shall be platted as a single lot in the next <br />phase of development. <br />6. The preliminary plat shall be revised to show the trail easement along Elmcrest Avenue <br />North. <br />7. The preliminary plat shall be revised to show the 20 -foot easement over the sidewalk <br />adjacent to Street A and the sidewalk through Oudot A. The easement document must be <br />submitted for review and approval by City staff and must be filed with the final plat. If the <br />easement document was recorded with Victor Gardens North Village P Addition please <br />provide a copy of the recorded document for City files. <br />8. Park dedication requirements for this site have been met with previous additions. No <br />additional park dedication is required for this phase. <br />9. The developer shall obtain all necessary permits from the City. <br />
