RESOLUTION 2005-5 <br />APPROVING A PUD GENERAL PLAN FOR POA-SCHERER, LLC. FOR <br />"VICTOR GARDENS NORTH" ON PROPERTY LOCATED NORTH OF <br />FRENCHMAN ROAD (COUNTY ROAD 8) AND EAST OF ELMCREST <br />AVENUE NORTH <br />WHEREAS, POA -Scherer, LLC has requested approval of a PUD General Plan to allow <br />construction of 186 townhomes and approximately 69,900 square feet of commercial on a <br />the 46.43 -acre property legally described as follows: <br />Outlot A, Victor Gardens, Washington County, Minnesota. <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly <br />called Public Hearing and recontmends approval; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by POA -Scherer, LLC for a PUD general plan, subject to the following <br />conditions: <br />1. A PUD general plan/site plan is approved to allow the creation of 186 townhomes <br />(including 8 twinhomes), 1 commercial lot and 2 outlots in accordance with the <br />preliminary plat submittal received by the City on February 15, 2005, except as <br />amended by this resolution. <br />2. Approval is contingent upon City Council approval of the requested preliminary plat. <br />3. The development shall be consistent with the Victor Gardens PUD concept plan <br />approvals (Resolution # 2000-47), except as otherwise noted herein. <br />4. Development standards for the PUD shall be as indicated on the plans dated February <br />15, 2005 and graphics dated February 2, 2005, except as amended by this resolution. <br />5. All platted townhome lots (including twinhomes) shall comply with the following <br />setbacks: <br />Front yard from public street <br />15 feet <br />Between buildings <br />20 feet <br />Setback around the perimeter of the site <br />exterior property lines <br />30 feet <br />From commercial property line <br />15 feet <br />Required parking for townhomes <br />(including garage stalls) <br />2.5 stalls per unit <br />6. The grocery/retail building shall comply with the setbacks shown on the plans. <br />
