Resolution 2005-5 <br />Page 6 <br />11. Prior to recording the final plat, the applicant must comply with the following <br />conditions: <br />a. The existing drainage and utility easement over the outlot shall be vacated. <br />12. Prior to issuance of building permits, the applicant must comply with the following <br />conditions: <br />a. The applicant shall provide copies of the development covenants for City review. <br />A copy of the covenants shall be filed with the final plat. <br />b. The homeowner's association documents shall include language to ensure that the <br />enclosed garage spaces are maintained for vehicle parking and that parking of <br />snowmobiles, boats, RVs and other recreational vehicles in the driveway is <br />discouraged. The covenants shall be drafted to prohibit the storage of anything in <br />the garage or driveway that would prevent the storage and parking of vehicles. <br />Such language shall also be included in the Developers Agreement. <br />c. The homeowner's association documents and sales information shall note that the <br />property to the north is zoned Agricultural (AG) and that the intent of this district <br />is to provide an area for the production of livestock, dairy animals, dairy products, <br />poultry or poultry products, fur -bearing animals, horticultural or nursery stock, <br />fruit, vegetables, forages, grains, timber, trees, or bees and apiary products, and <br />other uses dependent on the inherent productivity of the land. <br />d. The developer's architectural control committee (ARC) shall review and approve <br />all building designs for compliance with this resolution, prior to building permit <br />submittal. A written copy of the ARC approval shall be submitted with the <br />building permit application for each building. The City shall review the building <br />architecture for compliance with the approved plans prior to issuance of building <br />permits. <br />e. The applicant shall obtain all necessary local, state, and federal permits. <br />f. The applicant must execute a cross access agreement with the property to the east <br />for the private "frontage" road in the commercial portion of the development. <br />This frontage road must be constructed when the east -west road (Street A) <br />connects to Everton. <br />g. The applicant shall pay their portion of the Everton Avenue Study AUAR costs, <br />based on the area of the Victor Gardens North Village project site ($17,097.32). <br />13. Staff will monitor the tenants within the development to ensure that adequate parking <br />is provided as tenants are finalized. <br />6., <br />
