The development agreement for Victor Gardens includes provisions whereby the <br />applicant is responsible for half of the cost of a traffic signal at the Victor Hugo <br />Boulevard/CSAH 8 intersection. The signal is slated for construction as part of <br />the CSAH 8 improvements. In the interim, a temporary traffic signal may be <br />necessary. If so, the applicant will be responsible for the entire cost based on the <br />provision of the development agreement. <br />z. The applicant shall deposit an amount in an escrow account with the City equal to <br />the cost to construct one-half of a standard City street for the Elmcrest Avenue <br />frontage. <br />Landscaping and Open Space <br />aa. The City grants the applicant a waiver from the Victor Gardens Concept Plan <br />approvals (Resolution 2000-47) requiring 25 percent shade in the parking lot <br />within 15 years. The retail development in this phase is approved in accordance <br />with the landscape plan, subject to the following: <br />1) The applicant must revise the landscaping plans to provide the calculation <br />for what percentage of the parking lot will be shaded within 15 years. <br />2) All future phases shall be subject to the conditions as approved in <br />Resolution 2000-47 regarding parking lot shading. <br />bb. Open space as shown on the plans shall be owned and maintained by the HOA. <br />cc. Landscaped areas shall be irrigated. The developer shall submit an irrigation plan <br />for review and approval by the City. <br />dd. The developer and/or the owner's association shall be responsible for <br />maintenance of the landscaping and irrigation systems within the development. <br />ee. Landscape details for the foundation plantings around the pylon and monument <br />signs must be submitted. <br />ff. Landscaping along the CSAH 8 frontage shall be coordinated with the <br />CSAR 8 landscape plan, and is subject to further review prior to approval of the <br />final plat. <br />Miscellaneous <br />gg. The residential site plan must also be revised to dimension the required and <br />proposed building setbacks. <br />hh. Emergency vehicle accesses must comply with City requirements. Details on <br />these accesses shall be provided for City review and approval. <br />ii. The applicant shall comply with all conditions from the City Engineer's memo <br />dated February 2, 2005. <br />
