RESOLUTION 2005-10 <br />APPROVING A FINAL PLAT FOR CENTEX HOMES AND PRATT <br />INVESTMENT FOR "HERITAGE PONDS 2ND ADDITION" ON PROPERTY <br />LOCATED EAST OF ELMCREST AVENUE, WEST OF EVERTON AVENUE <br />AND NORTH OF COUNTY ROAD 8EAST OF GOODVIEW AVENUE AND <br />SOUTH OF 149H STREET <br />WHEREAS, Centex Homes and Pratt Investment have requested approval of a final plat <br />to allow construction of 27 single-family homes and 120 townhome units on property <br />legally described as follows: <br />Outlot A and Outlot B, Heritage Ponds, Washington County, Minnesota. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Centex Homes and Pratt Investment for a final plat; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording of the final plat: <br />1. A final plat is approved to allow the creation of 27 single family lots and 120 <br />townhome units in accordance with the application received by the City on February <br />3, 2005, and revisions received on February 18, 2005, except as amended by this <br />resolution. <br />2. The applicant shall comply with the development standards in the preliminary plat <br />and PUD general plan approved by resolutions 2004-26 and 2004-27. <br />3. The development agreement must be executed by the developer and the City prior to <br />release of the final plat. <br />FURTHER, that the following conditions be met prior to issuance of building permits: <br />1. One full set of approved plans must be submitted to the City. <br />2. Homeowner association documents, cross access and maintenance agreements for <br />shared private driveways or streets, and drainage and utility easements for all private <br />drives must all be recorded with the final plat. <br />3. All platted residential lots shall comply with the following setbacks: <br />
