t <br />RESOLUTION 2005-12 <br />APPROVING A FINAL PLAT FOR E&G DEVELOPMENT FOR "DIAMOND POINT <br />EAST" ON PROPERTY LOCATED EAST OF GOODVIEW AVENUE AND SOUTH <br />OF 145TH STREET <br />WHEREAS, E&G Development has requested approval of a final plat to allow <br />construction of 125 homes on property legally described as follows: <br />The south half of the south half of the southeast quarter of the northwest quarter <br />of Section 21, Township 31, Range 21 together with an easement over the north <br />33 feet of the east 1940 feet of the southwest quarter of Section 21, Township 31, <br />Range 21 for purposes of ingress and egress. <br />AND <br />The southwest quarter of Section 21, Township 31, Range 21. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by E&G Development for a final plat; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording of the final plat: <br />1. A final plat is approved to allow the creation of 125 single family lots and 2 outlots, <br />in accordance with the application received by the City on January 10, 2005, and <br />revisions received on February 18, 2005, except as amended by this resolution. <br />2. The applicant shall comply with the development standards of the preliminary plat <br />and PUD approvals granted by Resolutions 2003-34 and 2003-35. <br />3. The dedication of the parkland to the City must be recorded with the final plat. <br />4. The development agreement must be executed by the developer and the City prior to <br />release of the final plat. <br />FURTHER, that the following conditions be met prior to issuance of building permits: <br />1. One full set of approved plans must be submitted to the City. <br />2. Homeowner association documents, cross access and maintenance agreements for <br />shared private driveways or streets, and drainage and utility easements for all private <br />drives must all be recorded with the final plat. <br />3.
