RESOLUTION 2005 - 27 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POA- <br />SCHERER, LLC FOR VICTOR GARDENS NORTH VILLAGE <br />WHEREAS, POA -Scherer has requested approval of a Final Plat for "Victor Gardens <br />North Village" on property legally described as follows: <br />Outlot A, Victor Gardens <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for POA -Scherer for Victor Gardens North Village; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the creation of one commercial lot and two <br />commercial outlots, in accordance with the plans received by the City on April 1, <br />2005, except as amended by this resolution. <br />2. The grading and drainage issues identified in the April 25, 2005 City Engineer's <br />memo must be addressed. <br />3. Drainage and utility easements must be provided over all ponds up to the 100 - <br />year event elevation. <br />4. Approval of the final plat is contingent upon approval of the vacation of the <br />drainage and utility easement over Outlot A, Victor Gardens. <br />5. The development agreement must be executed by the developer and the City prior <br />to release of the final plat. <br />6. Development standards shall be according to the PUD general plan and <br />preliminary plat approvals granted by the City Council on February 22, 2005, and <br />as may be amended. <br />7. Park dedication requirements for this site have been met with previous additions. <br />No additional park dedication is required for this phase. <br />8. The developer must obtain preliminary plat approval from Washington County <br />and comply will all conditions of plat approval. <br />
