RESOLUTION 2005 - 27 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR POA- SCHERER, LLC FOR VICTOR GARDENS NORTH VILLAGE WHEREAS, POA -Scherer has requested approval of a Final Plat for "Victor Gardens North Village" on property legally described as follows: Outlot A, Victor Gardens WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for POA -Scherer for Victor Gardens North Village; and FURTHER, that the development agreement for said final plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved to allow the creation of one commercial lot and two commercial outlots, in accordance with the plans received by the City on April 1, 2005, except as amended by this resolution. 2. The grading and drainage issues identified in the April 25, 2005 City Engineer's memo must be addressed. 3. Drainage and utility easements must be provided over all ponds up to the 100 - year event elevation. 4. Approval of the final plat is contingent upon approval of the vacation of the drainage and utility easement over Outlot A, Victor Gardens. 5. The development agreement must be executed by the developer and the City prior to release of the final plat. 6. Development standards shall be according to the PUD general plan and preliminary plat approvals granted by the City Council on February 22, 2005, and as may be amended. 7. Park dedication requirements for this site have been met with previous additions. No additional park dedication is required for this phase. 8. The developer must obtain preliminary plat approval from Washington County and comply will all conditions of plat approval.
