Resolution 2005-27 <br />Page 3 <br />e. The development agreement for Victor Gardens includes provisions whereby <br />the applicant is responsible for half of the cost of a traffic signal at the Victor <br />Hugo Boulevard/CSAH 8 intersection. The signal is slated for construction as <br />part of the CSAH 8 improvements. In the interim, a temporary traffic signal <br />may be necessary. If so, the applicant will be responsible for the entire cost <br />based on the provision of the development agreement. <br />f. The applicant shall deposit an amount in an escrow account with the City <br />equal to the cost to construct one-half of a standard City street for the <br />Elmcrest Avenue frontage. <br />6. Landscaping and Open Space <br />a. The City grants the applicant a waiver from the Victor Gardens Concept Plan <br />approvals (Resolution 2000-47) requiring 25 percent shade in the parking lot <br />within 15 years. The retail development in this phase is approved in <br />accordance with the landscape plan, subject to the following: <br />1) The applicant's plan shows 14.6 percent shading in the grocery <br />parking lot within 15 years. <br />2) All future phases shall be subject to the conditions as approved in <br />Resolution 2000-47 regarding parking lot shading. <br />b. landscaped areas shall be irrigated. The developer shall submit an irrigation <br />plan for review and approval by the City. <br />c. The developer and/or the owner's association shall be responsible for <br />maintenance of the landscaping and irrigation systems within the <br />development. <br />d. Landscape details for the foundation plantings around the pylon and <br />monument signs must be submitted. <br />e. Landscaping along the CSAH 8 frontage shall be coordinated with the CSAH <br />8 landscape plan, and is subject to further review prior to approval of the final <br />plat. <br />7. Miscellaneous <br />a. The developer must comply with all conditions outlined in the City Engineer's memo <br />dated April 25, 2005. <br />b. The applicant shall provide copies of the development covenants for City review. A copy <br />of the covenants shall be filed with the final plat. <br />c. The developer's architectural control committee (ARC) shall review and approve all <br />building designs for compliance with this resolution, prior to building permit submittal. <br />A written copy of the ARC approval shall be submitted with the building permit <br />
