RESOLUTION 2004-14 <br />APPROVING PRELEM INARY PLAT FOR OAKWOOD LAND DEVELOPMENT <br />FOR "BEAVER PONDS SOUTH" FOR PROPERTY LOCATED SOUTH OF <br />128H STREET AND NORTH OF 125' STREET <br />WHEREAS, Oakwood Land Development has requested approval of a preliminary plat <br />to allow construction of 45 homes on property legally described as follows: <br />The southeast quarter of the northwest quarter of Section 32, Township 31, Range <br />21, except the south 652 feet thereof, Washington County, Minnesota. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Oakwood Land Development for a preliminary plat, subject to the following <br />conditions: <br />1. A preliminary plat is approved to allow the creation of 41 single family lots and one <br />lot to be dedicated to the City for park land, in accordance with the plans and <br />application received by the City on January 9, 2004 and January 20, 2004, except as <br />amended by this resolution. <br />2. Development is subject to the R-3 district standards. No variances are granted or <br />implied. <br />3. The park dedication land shall be deeded to the City with the final plat. <br />4. Sidewalks or trails shall be provided according the Park Commission <br />recommendation. <br />5. The Preliminary Plat shows an easement over the southern half of Block 5 to be <br />vacated. The applicant will need to provide the necessary legal description and proof <br />of vacation prior to Final Plat approval. <br />6. The developer shall submit a light plan with fixture details for City review prior to <br />final plat. <br />7. A revised landscape plan shall be submitted and shall address the following: <br />a. The species of trees shall be identified. <br />b. The deciduous trees shall be a minimum of 2.5 -inches in diameter. <br />c. No more than 25 percent of the deciduous trees shall be of any one <br />species. <br />
