RESOLUTION 2004-23 <br />APPROVING A PUD AMENDMENT FOR POAC-CRAIN, LLC. FOR "VICTOR <br />GARDENS 4TH ADDITION" ON PROPERTY LOCATED AT THE <br />SOUTHWEST QUADRANT OF EVERTON AVENUE NORTH AND <br />FRENCHMAN ROAD (COUNTY ROAD 8) <br />WHEREAS, POAC-Crain, LLC has requested approval of a PUD Amendment to allow <br />construction of 92 townhome units on a portion of the 23.64 -acre property legally <br />described as follows: <br />That part of the Southeast Quarter of the Northwest Quarter of Section 19, <br />Township 31 North, Range 21 West, Washington County, Minnesota, <br />lying Southerly of the center line of Frenchman road North (a/k/a County <br />State Aid Highway No. 8). <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by POAC-Crain, LLC for a PUD general plan amendment, subject to the <br />following conditions: <br />1. A preliminary plat is approved to allow the creation of 92 townhomes, 9 common lots <br />and two commercial lots in accordance with the plans received on March 22, 2003, <br />except as amended by this resolution. <br />2. Approval is contingent upon City Council approval of the requested comprehensive <br />plan amendment, rezoning and preliminary plat. <br />3. Development standards for the PUD shall be as indicated on the plans dated March <br />22, 2004, except as amended by this resolution. <br />4. All platted townhome lots shall comply with the following setbacks: <br />Front yard from public street <br />15 feet <br />Between buildings <br />20 feet <br />Setback around the perimeter of the site <br />exterior property lines <br />30 feet <br />From commercial property line <br />15 feet <br />Required Parking for townhomes <br />(imIuding garage stalls <br />2.5 stalls per unit <br />5. The applicant should work with staff to revise the landscape plan to provide the <br />maximum possible number of coniferous trees, to meet the intent of the ordinance. <br />Specifically, the trees species should be water tolerant species to be planted near the <br />wetlands. <br />
