RESOLUTION 200433 <br />APPROVING A PUD (PLANNED UNIT DEVELOPMENT) FOR PULTE HOMES <br />OF MINNESOTA FOR "WATERS EDGE SOUTH" ON PROPERTY LOCATED <br />EAST OF EVERTON AVENUE NORTH, SOUTH OF "WATERS EDGE <br />NORTH" AND NORTH OF COUNTY ROAD 8 <br />WHEREAS, Pulte Homes of Minnesota have requested approval of a PUD for "Waters <br />Edge North" on property legally described as follows: <br />And <br />The north one-half of the northwest quarter of the northeast quarter of <br />Section 19, Township 31, Range 21 West <br />The northeast quarter of the southeast quarter and the southeast quarter of the <br />southeast quarter of Section 18, Township 31 north, Range 21 west, subject to the <br />right-of-way easements of the St. Paul and Duluth Railway and power lines. <br />According to the United States Government Survey thereof. <br />WHEREAS, the Planning Commission has reviewed the PUD amendment at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Pulte Homes of Minnesota for a PUD amendment, subject to the following <br />conditions: <br />1. A PUD amendment is approved to allow the creation of 534 townhouse lots, in <br />accordance with the plans and application received by the City on February 19, 2004 <br />and revisions received on March 23, 2004, except as amended by this resolution. <br />2. Development standards for the PUD shall be as indicated on the plans dated March <br />23, 2004, except as amended by this resolution. <br />3. Approval is contingent upon City Council approval of the requested rezoning and <br />preliminary plat. <br />4. The PUD general plan is approved based on the finding that the proposed project is <br />consistent with the City's Comprehensive Plan. <br />5. The applicant shall provide copies of the HOA documents/covenants for City review. <br />6. The applicant shall develop and implement architectural review and design guidelines <br />for all residential buildings. The guidelines must be submitted for City review and <br />approval. These guidelines shall be consistent with the neighborhood design <br />
