Resolution 2004-33 <br />Page 6 <br />50. The HOA shall be responsible for maintenance of sidewalks within the development. <br />Parks/Open Space <br />51. Park dedication shall be cash in lieu of fees due at the time of final plat. <br />52. The HOA documents shall ensure that the pool and community building are owned <br />and maintained by the HOA. <br />Drainage/Stormwater Management <br />53. The applicant shall obtain approval of the land development plan by the Rice Creek <br />Watershed District and the City of Hugo, including the proposed wetland impacts and <br />mitigation. <br />54. The plans shall note the ordinary high water and 100 -year high water elevation for all <br />water bodies. <br />55. The plans shall be revised to show the floodplain boundary. <br />56. The minimum floor elevation shall comply with Section 1175-060.1 of the Hugo <br />Zoning Ordinance. <br />57. The developer shall enter into an agreement with the City and the developer of the <br />Powers/Neeser property (Leonard Pratt, Pratt Homes), to complete the work plan to <br />address the regional ponding issues and FEMA map revisions. <br />Miscellaneous <br />58. The applicant shall pay their portion of the Everton Avenue Study AUAR costs, <br />based on the area of the project site. <br />59. The applicant shall comply with all conditions in the City Engineer's letter dated <br />April 1, 2004. <br />60. The covenants for this development should include language to make homeowners <br />aware that the land west of this development is zoned agriculture, is not planned to <br />urbanize and will include noises, odors and activities consistent with rural <br />development. <br />61. A temporary sales trailer is approved to be located on the Wagners Greenhouse site as <br />shown on the plans. A building permit is required for this temporary trailer with <br />gravel parking. The temporary trailer must be removed within 9 months or when a <br />model home is available for use a sales office, whichever is sooner. <br />
