Resolution 2004-33 <br />Page 5 <br />37. The maximum driveway curb cut width shall be 24 feet. <br />38. The right-of-way for the parkway shall be dedicated with the final plat for the first <br />phase of the development. <br />39. Cross access and maintenance agreements shall be recorded with the final plat for all <br />shared private driveways or streets. <br />40. Drainage and utility easements shall be recorded with the final plat for all private <br />drives. <br />41. The applicant must obtain an easement or encroachment agreement from the property <br />owner to the south to allow grading on that property as currently shown. <br />42. The development shall comply with the Fire Chief s requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane <br />signage. <br />43. The City will reimburse the developer for the cost of increasing the size of the <br />waterline 24" where requested by the City. The applicant shall work with the City <br />Engineer to size and utilities. <br />Sidewalks and Trails <br />44. A 10 -foot wide trail shall be constructed on the east side of the parkway. This trail <br />shall extend to both the north and south property lines. <br />45. A 5 -foot wide sidewalk shall be constructed on the west side of the parkway. This <br />trail shall extend to both the north and south property lines. <br />46. A minimum 5 -foot wide boulevard shall be maintained between the parkway and the <br />sidewalk or trail and the boulevard shall be maximized where possible. This area <br />shall be landscaped with canopy trees according to the parkway landscaping plan to <br />be approved by the City. <br />47. Sidewalks and trails shall be provided through out the development as shown on the <br />plans submitted by the applicant on March 22, 2004, except as amended by this <br />resolution. <br />48. A sidewalk shall be constructed on the south side of Flyway Street adjacent to the <br />homes. <br />49. Sidewalks are proposed along all public streets. At the time of final plat review, the <br />City may require sidewalk easements or additional drainage and utility easements to <br />insure adequate area for utility installation and the landscape plantings. <br />
