Resolution 2004-34 <br />Page 3 <br />20. Cross access and maintenance agreements shall be recorded with the final plat for all <br />shared private driveways or streets. <br />21. Drainage and utility easements shall be recorded with the final plat for all private <br />drives. <br />22. The applicant must obtain an encroachment agreement or easement from the property <br />owner to the south to allow grading on that property. <br />23. The developer must obtain all necessary permits from Rice Creek Watershed District. <br />24. The development shall comply with the Fire Chief s requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane <br />signage. <br />25. Park dedication shall be cash in lieu of dedication. <br />26. The developer shall work with the City and MCES to address the interceptor <br />overflow pipe issues. <br />27. The applicant shall pay their portion of the Everton Avenue Study AUAR costs, <br />based on the area of the project site. <br />28.
