RESOLUTION 2004-38 APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR EMMERICH DEVELOPMENT CORPORATION ON PROPERTY LOCATED WEST OF GOODVIEW AVENUE AND SOUTH OF 145m STREET WHEREAS, Emmerich Development Corporation has requested approval of a final plat to allow construction of 39 single family detached homes on property legally described as follows: ". Zi X, Outlots A, B and D, Diamond Point West, according to the recorded plat thereof, Washington, County, Minnesota. Government Lot 1, Section 29, Township 31 North, Range 21 West, except the west 100 feet and except the south 600 feet thereof, according to the United States Government Survey thereof, Washington County, Minnesota. WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for Emmerich Development Corporation for Diamond Point West 2nd Addition; and FURTHER, that the development agreement for said plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved to allow the construction of 39 townhomes and 2 oudots, in accordance with the plans received by the City on March 16, 2004, except as amended by this resolution. 2. The development agreement must be executed by the developer and the City prior to release of the final plat.
