RESOLUTION 2004-53 <br />APPROVING A PUD AMENDMENT FOR POA-SCHERER, LLC. FOR <br />"VICTOR GARDENS 5" ADDITION" ON PROPERTY LOCATED IN THE <br />SOUTHEAST QUADRANT OF ELMCREST AVENUE AND FRENCHMAN <br />ROAD <br />WHEREAS, POA -Scherer, LLC has requested approval of a PUD Amendment to allow <br />construction of 36 single-family homes and 5 outlots on an 83 -acre property legally <br />described as follows: <br />Oudot C, Victor Gardens 1"` Addition, according to the recorded plat <br />thereof, Washington County, Minnesota, excepting therefrom, that part <br />platted as Victor Gardens 2"d Addition, according to the recorded plat <br />thereof, said Washington County, Minnesota <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by POA -Scherer, LLC for a PUD general plan amendment, subject to the <br />following conditions: <br />1. A PUD general plan/site plan is approved to allow the creation of 36 single-family <br />homes and 5 outlots in accordance with the plans received on June 25, 2004, except <br />as amended by this resolution. <br />2. Approval is contingent upon City Council approval of the requested preliminary plat. <br />3. The development is subject to the Victor Gardens PUD Concept approvals (Res. <br />2000-47). <br />4. The developer shall revise the plans to comply with the 65 -foot minimum lot width as <br />shown on the July 12, 2004 concept. <br />5. Development standards are as follows: <br />Minimum Front Yard Setbacks: <br />House setback (traditional homes) <br />15 feet <br />Garage setback front facie <br />25 feet <br />Garage setback (side facing) <br />20 feet <br />Side Yazd: <br />Interior lot traditional homes <br />10 feet <br />Interior lot (garages) <br />5 feet <br />Corner lot (house) <br />15 feet <br />
