Building materials shall be as shown on the plans. The material samples shall be <br />submitted for City review and approval prior to final plat. <br />7. PUD flexibility is granted to vary from the typical shoreland lot area and lot width <br />requirements, based on the finding that: <br />a. The proposed plat is consistent with the approved Victor Gardens PUD <br />Concept plan. <br />b. The applicant has proposed oudots adjacent to the creek, which will <br />remain natural. <br />c. The homes comply with the setback requirements. <br />d. The City has an adopted stormwater management program that reduces the <br />need for the larger lots and increased setbacks, which are intended to <br />reduce runoff into the lakes. The stormwater management program <br />adequately addresses this issue. <br />e. The total impervious surface within the development will be less than 25 <br />percent. <br />f. The developer will implement BMPs (Best Management Practices) to <br />ensure adequate protection of the lake during construction. <br />g. The master plan for this development would comply with the purpose and <br />intent of the shoreland requirements, which is to preserve the quality of <br />the adjacent creek. <br />8.
