N <br />1� <br />RESOLUTION 2004-69 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PRATT <br />INVESTMENT AND CENTEX HOMES FOR "HERITAGE PONDS" ON <br />PROPERTY LOCATED EAST OF ELMCREST AVENUE, WEST OF EVERTON <br />AVENUE AND NORTH OF COUNTY ROAD 8 <br />WHEREAS, Pratt Investments and Centex Homes have requested approval of a Final <br />Plat for "Heritage Ponds" on property legally described as follows: <br />The southwest quarter of the northwest quarter and the north half of the southwest <br />quarter, Section 18, Township 31 North, Range 21 West, located in Washington <br />County, Minnesota. <br />Together with <br />The southeast quarter of the northwest quarter of Section 18, Township 31 North, <br />Range 21 West, Washington County, Minnesota. <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Pratt Investments and Centex Homes for Heritage Ponds; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the construction of phase I, in accordance with <br />the plans received by the City on September 13, 2004, except as amended by this <br />resolution. <br />2. The development agreement must be executed by the developer and the City prior <br />to release of the final plat. <br />3. Development standards shall be according to the PUD general plan and <br />preliminary plat approvals granted by the City Council on May 3, 2004, and as <br />may be amended. <br />4. Cross access and maintenance agreements shall be recorded with the final plat for <br />all shared private driveways or streets. <br />
