RESOLUTION 2004-73 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR PULTE <br />HOMES FOR WATERS EDGE SOUTH ON PROPERTY LOCATED EAST OF <br />EVERTON AVENUE NORTH IN THE NORTHEAST QUADRANT OF <br />SECTION 18, TOWNSHIP 31, RANGE 21 <br />WHEREAS, Pulte Homes of Minnesota have requested approval of a Final Plat for <br />"Waters Edge South" on property legally described as follows: <br />SEE ATTACHMENT A <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE TT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Pulte Homes for Waters Edge South; and - <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved in accordance with the revised plans received by the City <br />on September 24, 2004, except as amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior <br />to release of the final plat. <br />3. Development standards shall be according to the rezoning, PUD general plan and <br />preliminary plat approvals granted by the City Council on May 17, 2004, and as <br />may be amended. <br />4. HOA documents must be filed with the final plat at Washington County. <br />5. Cross access and maintenance agreements shall be recorded with the final plat for <br />all shared private driveways or streets. <br />6. Drainage and utility easements shall be recorded with the final plat for all private <br />drives. <br />7. The Xcel Energy pipeline easement must be filed with the final plat. <br />
