I <br />Resolution 2004-80 <br />Page 2 <br />along said East line, 400.24 feet to the North line of the South 400 feet of <br />said Northwest Quarter of the Southeast Quarter; thence Westerly along <br />said North line, 1319.85 feet to said North-South Quarter line; thence <br />Southerly along said North-South Quarter line, 194.04 feet to the point of <br />beginning. Subject to Everton Avenue North along the most Westerly <br />line. Subject to and together with any other valid easements, restrictions <br />and reservations, Washington County, Minnesota. <br />Abstract <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Pulte Homes for Waters Edge North; and <br />FURTHER, that the development agreement for said final plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the construction of phase I, in accordance with <br />the plans received by the City on August 3, 2004, except as amended by this <br />resolution. <br />2. The development agreement must be executed by the developer and the City prior <br />to release of the final plat. <br />3. Development standards shall be according to the PUD general plan and <br />preliminary plat approvals granted by the City Council on December 15, 2003, <br />and as may be amended. <br />4. The developer must provide easement documents for off-site construction of the <br />parkway. <br />5. Drainage and utility easements are required to be provided over the wetland on <br />Lot 1, Block 9. <br />6. Drainage and utility easements are required to be provided over the wetland on <br />Lots 3 and 4, Block 4. <br />7. Cross access and maintenance agreements shall be recorded with the final plat for <br />all shared private driveways or streets. <br />
