RESOLUTION 20034 <br />APPROVING PRELIMINARY PLAT FOR POA/SCHERER, LLC. FOR VICTOR <br />GARDENS 3'" ADDITION ON PROPERTY LOCATED SOUTH OF CSAH 8 AND <br />EAST OF EXISTING ELMCREST AVENUE NORTH <br />WHEREAS, POA/Scherer, .LLC. has requested approval of a preliminary plat to allow <br />construction of 99 townhomes on property legally described as follows: <br />Outlot B, Victor Gardens, according to the recorded plat thereof, Washington <br />County, Minnesota <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />preliminary plaf for POA/Scherer, LLC on property located south of CSAH 8 and east of <br />Ehncrest Avenue, subject to the following conditions: <br />1. A preliminary plat is approved to allow the construction of 99 townhomes on 13 lots, <br />two common lots and two outlots, in accordance with the plans and application <br />received by the City December 9, 2002 and December 20, 2002, except as amended <br />by this resolution. <br />2. Approval is contingent upon City Council approval of the PUD amendment. <br />3. Development standards shall be as approved as part of the PUD. <br />4. The developer shall revise the preliminary plat to clearly identify the outlot lot lines. <br />5. All platted townhome lots shall comply with the following setbacks: <br />Front yard from public street <br />15 feet <br />Between buildings <br />20 feet <br />Setback around the perimeter of the site <br />exterior property lines <br />30 feet <br />From commercial property line <br />15 feet <br />Required • parking for townhomes <br />(including garage stalls <br />2.5 stalls per unit <br />6.. The right-of-way for public streets shall be 50 -feet wide. <br />7. The public street (Street A) shall be increased to 28 feet wide (face to face) with <br />parking on one side. The applicant shall work with City staff to finalize the street <br />design prior to final plat approval. <br />
