RESOLUTION 2003-18 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR <br />POA/SCHERER, LLC. FOR VICTOR GARDENS P ADDITION ON PROPERTY <br />LOCATED SOUTH OF CSAH 8 AND EAST OF EXISTING ELMCREST AVENUE <br />NORTH <br />WHEREAS, POA/Scherer, LLC. has requested approval of a final plat to allow <br />construction of 99 townhomes on property legally described as follows: <br />Outlot B, Victor Gardens, according to the recorded plat thereof, Washington <br />County, Minnesota <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for POA/Scherer, LLC for Victor Gardens P Addition; and <br />FURTHER, that the development agreement for said plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the construction of 99 townhomes on 13 lots, two <br />common lots and two outlots, in accordance with the plans and application received <br />by the City February 28, 2003, except as amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior to <br />release of the final plat. <br />3. Approval of the final plat is contingent upon vacation of the existing drainage and <br />utility easement over Outlot B, Victor Gardens. <br />4. Development standards shall be according to the PUD general plan and preliminary <br />plat approvals granted by the City Council on January 21, 2003. The developer must <br />comply with all conditions of approval prior to release of the final plat. <br />
