RESOLUTION 2003-20 <br />APPROVING A PUD GENERAL PLAN FOR HERITAGE DEVELOPMENT FOR <br />"EAGLE SHORES" ON PROPERTY LOCATED NORTH OF 122ND STREET <br />AND WEST OF EVERTON AVENUE <br />WHEREAS, Heritage Development has requested approval of a PUD general plan to <br />allow construction of 10 homes on 11 lots on property legally described as follows: <br />Outlots C, H, I and J, Lake Estates, Washington County, Minnesota <br />WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly <br />called Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Heritage Development for a PUD general plan, subject to the following <br />conditions: <br />1. A PUD general plan is approved to allow construction of 10 new single family homes <br />and retention of one existing single family home, in accordance with the plans and <br />application received by the City on February 14, 2003 and revisions received on <br />March 19, 2003, except as amended by this resolution.. <br />2. Approval is contingent upon City Council approval of the requested rezoning and <br />preliminary plat. <br />3. The PUD general plan is approved based on the finding that the proposed project is <br />consistent with the City's Comprehensive Plan. <br />4. Development standards for the PUD shall be as indicated on the plans dated March 5, <br />2003, except as amended by this resolution. <br />5. The development is located entirely in the Shoreland Overlay district. Development <br />is subject to the requirements of Section 1155.020.1 of the Zoning Ordinance, <br />including the following: <br />a. Not more than 25 percent impervious surface coverage shall be permitted on any <br />lot. Calculations must be submitted for review at the time of building permit <br />issuance. <br />b. The maximum building height shall not exceed 25 feet. <br />c. Any improvements in Outlot C, including an extension of the private trail or <br />installation of a dock, will require compliance with City regulations, shoreland <br />overlay district standards and DNR requirements. <br />6. The applicant shall provide copies of the HOA documents/covenants for City review. <br />7. The applicant shall develop and implement architectural review and design guidelines <br />for all residential buildings. The guidelines must be submitted for City review and <br />approval. <br />
