RESOLUTION 2003-21 <br />APPROVING PRELIMINARY PLAT FOR HERITAGE DEVELOPMENT FOR <br />"EAGLE SHORES" ON PROPERTY LOCATED NORTH OF 122ND STREET <br />AND WEST OF EVERTON AVENUE <br />WHEREAS, Heritage Development has requested approval of a preliminary plat to allow <br />the creation of 11 lots on this 12.16 -acre site legally described as follows: <br />Outlots C, H, I and J, Lake Estates, Washington County, Minnesota <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Heritage Development for a preliminary plat, subject to the following <br />conditions: <br />1. A preliminary plat is approved to allow the creation of 11 single family lots, in <br />accordance with the plans and application received by the City on February 14, 2003 <br />and revisions received on March 19, 2003, except as amended by this resolution. <br />1. Approval is contingent upon City Council approval of the rezoning from R 1 to PUD <br />and PUD general plan. <br />2. Development standards shall be as approved as part of the PUD. <br />3. The applicant shall provide copies of the HOA documentstcovenants for City review. <br />A copy of the covenants shall be filed with the final plat. <br />4. The right-of-way for the public street shall be 50 feet. <br />5. The public street may be reduced to 24 feet in width (back to back). <br />6. The applicant shall work with staff to shift the road within the right-of-way to ensure <br />that adequate space is preserved within the right-of-way for future installation of <br />municipal water. <br />7. All private utilities shall be located on the opposite side of the right-of-way from the <br />planned municipal water service. <br />8. The applicant shall provide 30 -foot wide easements between Lots 3 and 4 and <br />between Lots 5 and 6 to accommodate future watermain looping. <br />
