The applicant may either pay a cash escrow for the future municipal water <br />improvements, or enter into an assessment agreement for the future improvements. <br />The assessment agreement, among other things, will require the property to waive all <br />rights to appeal any future assessments under Minnesota Statues 429. <br />10. Drainage and utility easements (6 -foot side and 12 -foot front and rear, except as <br />otherwise noted) shall be recorded with the final plat. <br />11. Easements for the storm sewer outlet west of this site shall be shown on the <br />preliminary plat. <br />12. The applicant shall obtain approval of the land development plan by the Rice Creek <br />Watershed District and the Department of Natural Resources, including the proposed <br />discharge into Bald Eagle Lake. <br />13. The City will reimburse the developer for the cost of increasing the size of the storm <br />sewer to 24 -inches and V2 of the cost of 122nd Street reconstruction. The cost of the <br />City participation should be based on the actual construction costs for the proposed <br />pipe upsizing and street replacement cost. The City participation shall not exceed the <br />$27,824.00 amount indicated in the cost participation calculation. <br />14. The applicant shall work with the City to finalize the alignment of the storm sewer <br />proposed in 122nd Street. <br />15. Easements must be provided over the infiltration ponds shown in the rear yards of <br />Lots 6, 7, 8 and 9. <br />16. The storm sewer easement needed for extension of the storm sewer outlet west of this <br />site must be shown on the site plan and preliminary plat. <br />17. The applicant shall be responsible for obtaining the 30 -foot easement required to <br />extend the storm sewer system to discharge into Bald Eagle Lake. <br />18. The plat shall comply with the City's street naming system, except as otherwise <br />approved by the City Council. <br />19. The developer must obtain all necessary permits from Rice Creek Watershed District <br />and the Department of Natural Resources. <br />20. The development shall comply with the Fire Chief s requirements regarding fire flow <br />calculations, the location of fire hydrants, fire department connections, and fire lane <br />signage. <br />21. The developer shall comply with all City requirements from the City water resource <br />engineer and the City Engineer. <br />
