Resolution 2003 - <br />Page 2 <br />FURTHER, that the development agreement for said plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow the construction of 52 townhomes and 4, in <br />accordance with the plans received by the City on March 27, 2003, except as <br />amended by this resolution. <br />2. The development agreement must be executed by the developer and the City prior to <br />release of the final plat. <br />3. Development standards shall be according to the PUD general plan and preliminary <br />plat approvals granted by the City Council on August 5, 2003, and as may be <br />amended. The developer must comply with all conditions of approval prior to <br />issuance of building permits. <br />4. The developer must obtain all necessary permits from Rice Creek Watershed District. <br />5. The developer shall comply with all requirements from the City Engineer <br />6. The developer shall comply with requirements in memo from the City Water <br />Resources Engineer dated April 28, 2003, prior to release of the final plat. <br />7. Final utility plans and details must be submitted for review and approval by City staff <br />prior to release of final plat. <br />8.
