Resolution 2003-25 <br />Page 2 <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Fegowi Development, Inc. for Oneka Ponds; and <br />FURTHER, that the development agreement for said plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow 68 single family home lots and one outiot, in <br />accordance with the plans received by the City on May 5, 2003, except as amended <br />by this resolution. <br />2. The development agreement must be executed by the developer and the City prior to <br />release of the final plat. <br />3. Development standards shall be according to the preliminary plat (Res. 2002-53) <br />approvals granted by the City Council on October 7, 2002. The developer must <br />comply with all conditions of approval prior to issuance of building permits. <br />4. Approval of the final plat is contingent upon municipal utilities being provided from <br />the west. The timing of that utility extension is unknown at this time. Up to six <br />permits for model homes shall be issued, but no Certificate of Occupancy shall be <br />issued until municipal utilities are available. <br />5. Oudot A shall be dedicated to the City as the required park dedication. The City will <br />pay the developer $100,000 for the land dedication above the park dedication <br />requirements and the developer agrees to grade the park site and provide the required <br />wetland mitigation. <br />6. The plat shall be revised to comply with the City's street naming system. <br />7. A standard drainage and utility easement shall be provided to the City along the north <br />and east property line of the subdivision. The easement will be located over an <br />existing NSP (Xcel Energy) easement identified in Book No. 142, Page 154-155, <br />Doc. No. 3012107 as shown on the plat. The required easement shall be provided and <br />the final plat shall be revised for City review prior to release of the final plat for <br />recording. <br />
