RESOLUTION 2003-26 <br />APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR <br />HERITAGE DEVELOPMENT FOR "EAGLE SHORES" ON PROPERTY <br />LOCATED NORTH OF 122ND STREET AND WEST OF EVERTON AVENUE <br />WHEREAS, Heritage Development has requested approval of a final plat to allow <br />construction of 11 single family lots on property legally described as follows: <br />Outlots C, H, I and J, Lake Estates, Washington County, Minnesota <br />WHEREAS, the City has prepared a development agreement covering the improvements <br />related to said plat; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final <br />plat for Heritage Development for Eagle Shores; and <br />FURTHER, that the development agreement for said plat be approved, and that the <br />Mayor and City Administrator be authorized to execute the development agreement on <br />behalf of the City; and <br />FURTHER, that the following conditions be met prior to recording the final plat: <br />1. A final plat is approved to allow 11 single family home lots and 3 oudots, in <br />accordance with the plans received by the City on April 24, 2003, except as amended <br />by this resolution. <br />2. The development agreement must be executed by the developer and the City prior to <br />release of the final plat. <br />3. Development standards shall be according to the PUD general plan (Res. 2003-20) <br />and preliminary plat (Res. 2003-21) approvals granted by the City Council on April <br />21, 2003. The developer must comply with all conditions of approval prior to <br />issuance of building permits. <br />4. The developer must obtain all necessary permits from Rice Creek Watershed District <br />and Minnesota Department of Natural Resources, including any MnDNR approvals <br />for a shared dock on Bald Eagle Lake. <br />5. The final plat is approved based on the finding that the proposed lots exceed all <br />minimum lot size standards for the DNR and City of Hugo shoreland requirements. <br />No density bonuses are requested or approved. <br />6. The developer shall revise the final plat to provide a 30 -foot drainage and utility <br />easement on the rear (north) of Lot 3 for a future extension of watermain. <br />7. The applicant shall provide copies of the HOA documents/covenants for City review <br />prior to release of the final plat. A copy of the covenants shall be filed with the final <br />plat. <br />
