The applicant shall work with staff and the private utility companies to ensure that <br />adequate space is preserved within the right-of-way/easements for installation of all <br />utilities and future installation of municipal water. <br />9. The storm sewer easement needed for extension of the storm sewer outlet west of this <br />site must be shown on the site plan and preliminary plat. <br />10. The applicant shall be responsible for obtaining the 30 -foot easement required to <br />extend the storm sewer system to discharge into Bald Eagle Lake. <br />11. The plat shall be revised to comply with the City's street naming system. <br />12. The developer shall comply with all requirements from the City Engineer, prior to <br />release of the final plat. <br />13. The developer shall comply with requirements from the City Water Resources <br />Engineer, prior to release of the final plat. <br />14. Final construction plans, including drainage documents, must be submitted for review <br />and approval by City staff prior to release of final plat. <br />15. Park dedication shall be fees -in -lieu of dedication for the 10 new lots. Park <br />dedication fees will be due prior to release of the final plat for recording. <br />16. The applicant may either pay a cash escrow for the future municipal water <br />improvements, or enter into an assessment agreement for the future improvements. <br />The assessment agreement, among other things, will require the property to waive all <br />rights to appeal any future assessments under Minnesota Statues 429. <br />ADOPTED by the City Council this 19'' day of May 2003. <br />ATTEST: <br />Mary A reager, City Clerk <br />iron, Mayor <br />
