RESOLUTION 2003-34 <br />APPROVING PRELIMINARY PLAT FOR EMMERICH DEVELOMENT <br />CORPORATION FOR `DIAMOND POINT EAST" ON PROPERTY LOCATED <br />ON EAST OF GOODVIEW AVENUE AND SOUTH OF 145m STREET <br />WHEREAS, Emmerich Development Corporation has requested approval of a <br />preliminary plat to allow construction of 125 homes on property legally described as <br />follows: <br />The south half of the south half of the southeast quarter of the northwest quarter <br />of Section 21, Township 31, Range 21 together with an easement over the north <br />33 feet of the east 1940 feet of the southwest quarter of Section 21, Township 31, <br />Range 21 for purposes of ingress and egress. <br />0 <br />The southwest quarter of Section 21, Township 31, Range 21. <br />WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called <br />Public Hearing and recommends approval, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL. OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />request by Emmerich Development Corporation for a preliminary plat, subject to the <br />following conditions: <br />1. A preliminary plat is approved to allow the creation of 125 single family lots and 2 <br />outlots, in accordance with the plans and application received by the City on May 6, <br />2003, except as amended by this resolution. <br />2. Approval is contingent upon the Goodview Avenue reconstruction. Goodview <br />Avenue shall be constructed prior to approval of the final plat. <br />3. Approval is contingent upon City Council approval of the Comprehensive Plan <br />amendment, the PUD general plan and rezoning from R-3 to PUD. <br />4. Development standards shall be as approved as part of the PUD. <br />5. The land proposed for park dedication shall be deeded to the City with the final plat <br />for the first phase of the development. <br />6. The applicant shall provide copies of the HOA documents/covenants for City review. <br />A copy of the covenants shall be filed with the final plat. <br />7. The HOA documents shall ensure that the private open space is preserved. <br />
