. Resolution 2003-35 <br />' Page 5 <br />Sidewalks and Trails <br />35. Sidewalks and trails shall be provided in compliance with the Park Commission <br />recommendations. <br />36. The HOA shall be responsible for maintenance of sidewalks within the development. <br />Parks/Open Space <br />37. The land proposed for park dedication shall be deeded to the City with the final plat <br />for the first phase of the development. <br />38. The HOA documents shall ensure that private open space shall be preserved. <br />Drainage/Stormwater Management <br />39. The applicant shall obtain approval of the land development plan by the Rice Creek <br />Watershed District, including the proposed wetland impacts and mitigation. <br />40. Prior to final plat approval, the applicant must receive all City and watershed <br />approvals for the storm water drainage system. Construction of the required drainage <br />improvements shall be coordinated with improvement to the trunk drainage system. <br />41. The minimum floor elevation shall comply with Section 1175-060.1 of the Hugo <br />Zoning Ordinance. The applicant shall provide minimum floor elevations for all units <br />to ensure compliance with City requirements. <br />42. The applicant shall provide a wetland mitigation plan for City review. <br />43. The applicant shall comply with all conditions from the City water resources engineer <br />letter dated May 5, 2003. <br />Shoreland Management <br />44. The developer must obtain all necessary permits from Rice Creek Watershed District <br />and Minnesota Department of Natural Resources. <br />45. The final plat is approved based on the finding that the proposed lots comply with the <br />density standards of the City of Hugo and the shoreland requirements. No density <br />bonuses are requested or approved. <br />46. PUD flexibility is approved to for development within the shoreland overlay district, <br />based on the following findings: <br />
