RESOLUTION 2002-24 <br />APPROVING A 46 -FOOT VARIANCE TO PERMIT A 2,520 SQUARE FOOT <br />POLE BUILDING TO BE LOCATED CLOSER TO THE ROAD THAN THE <br />HOME ON PROPERTY LOCATED AT 7215137TH STREET NORTH. <br />WHEREAS, an application has been filed by Thomas and Reenae Glidden that requests <br />approval of a variance to permit a 2,520 square foot pole building to be located closer to <br />the road than the home on property located at 7215 1374` Street, as legally described as <br />follows: <br />Insert Legal <br />WHEREAS, the Board of Zoning Appeals and Adjustments has reviewed said variance at <br />a duly called public meeting and recommends approval of the variances. <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the <br />variance for Thomas and Reenae Glidden on property located at 7215 137x' Street North, <br />subject to the following conditions: <br />1. Variance is approved to allow a 2,520 square foot pole building to be located in <br />front of the home in accordance with the application dated May 30, 2002, subject <br />to the following conditions: <br />2. The pole building shall only be used for the storage of personal belongings and <br />vehicles. <br />3. The variances are approved based on the following findings: <br />a. The variance as requested is permissible bylaw. <br />The requested variance is from the dimensional requirements of the ordinance and <br />is permissible by law. <br />b. The strict enforcement of the ordinance would cause undue hardship because of <br />circumstances unique to the individual property not caused by the landowner. <br />The hardship is unique to the property because the setback of the home far <br />exceeds the 40 -foot minimum front yard setback required by ordinance. The <br />increased setback of the home and the zoning ordinance requirement for the pole <br />building to be no closer to the road than is the home creates a unique hardship. <br />Additionally, the applicant wishes to maintain the alfalfa field that is currently <br />behind the home and does not have easy access behind the home because of the <br />location of the drain field. <br />c. The granting of the variance would be in keeping with the spirit and intent of the <br />ordinance. <br />
