Resolution 2UU2-24 <br />Page 2 <br />The 60 X 42 foot building would encroach into the required front yard setback by <br />46 feet. The entire building would be in front of the home but would be <br />approximately 85 feet to the west of the home and behind a stand of trees. As <br />such, the pole building would be keeping with the spirit and intent of the <br />ordinance, which is to prevent accessory buildings from visually dominating the <br />appearance of the property by being located between the home and road. <br />d. The property can not be put to reasonable use without the granting of the <br />variance. <br />The property is planned and zoned for Rural Residential and the property across <br />the street is zoned Agricultural. Pole buildings and other similar accessory <br />buildings are a common use in the agricultural and rural residential zoning <br />districts and are often needed for storage of equipment, personal belongings, and <br />other items consistent with a rural lifestyle. <br />e. The variance, if granted, would not alter the essential character of the locality in <br />which it would be located. <br />The proposed building would not alter the character of this area because pole <br />buildings are common in rural and agricultural areas, and the applicant would <br />meet the spirit and intent of the ordinance by locating the building to the west of <br />the home, behind a stand of trees, to avoid having the accessory buildings <br />dominate the appearance of the property. <br />f. The variance, if granted shall not have the effect of allowing, in any district, any <br />use prohibited in the district. <br />The proposed pole building is a permitted accessory use in the rural residential <br />zoning district. <br />g. The variance, if granted, shall not permit a lower degree of flood protection than <br />required by the ordinance. <br />The subject property is not within a floodplain. <br />h.
