FJ <br />Resolution 2002-39 <br />Page 2 <br />And <br />That part of the Southwest Quarter of the Northwest Quarter of Section <br />30, Township 31 North, Range 21 West, Washington County, Minnesota, <br />described as follows: <br />Commencing at the southwest comer of said Southwest Quarter of the <br />Northwest Quarter thence North 0 degrees 36 minutes 23 seconds West, <br />assumed bearing along the west line of said Southwest Quarter of the <br />Northwest Quarter, 300.00 feet to the point of beginning of the parcel to <br />be described; thence South 89 degrees 32 minutes 20 seconds East, 1470 <br />feet, more or less to the east line of said Southwest Quarter of the <br />Northwest Quarter, thence northerly along said east line, 312 feet, more or <br />less, to the north line of the South 604.68 West of said Southwest Quarter <br />of the Northwest Quarter, thence westerly along said north line, 1287 feet, <br />more or less, to the enter line of Elmcrest Avenue North; thence <br />southeasterly, along said center line, 366 feet, more or less to the point of <br />beginning. <br />Subject to Elmcrest Avenue North, This tract contains 10.00 acres, more <br />or less. Subject to and together with any other valid easements, restrictions <br />and reservations. <br />WHEREAS, the Planning Commission has reviewed the site plan at a duly called Public <br />Hearing and recommends approval, and; <br />WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from <br />R-3 and R-1 to PUD; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request <br />by Lakeview Hugo LLP for the reclassification of the zoning from R-3 and R-1 to PUD <br />for a 102 -acre property located east of Elmcrest Avenue, west of Fenway Boulevard, <br />north of 130" Street and south of 140" Street, based on the following findings: <br />1. The proposed rezoning is consistent with the Comprehensive Plan and other City <br />policies and plans. The development would allow single-family detached homes at a <br />net density of 1.44 units per acre, which is consistent with the Comprehensive Plan <br />and Zoning Ordinance requirements. <br />2. The proposed development meets the intent of the PUD zoning district by providing <br />an efficient use of land by using reduced street widths and smaller lots on the eastern <br />portion of the site to preserve wetlands and provide larger, estate lots on the western <br />portion of the site. <br />
