Resolution 2001-2 <br />Page 2 <br />Comprehensive Land Use regulations. More specifically, the City Council finds the <br />following: <br />a) The proposed use is permissible by law. Schools are allowed in residential zoning <br />districts subject to the approval of a conditional use permit. <br />b) The proposed use is keeping with the spirit and intent of the ordinance. The proposed <br />school use is consistent with the residential zoning of the property. <br />c) The proposed use is compatible with the City's Comprehensive Plan, and the <br />character of the surrounding area. The existing school and temporary classroom <br />buildings are consistent with the Urban Development classification in the <br />Comprehensive plan. Further, the temporary classroom buildings would be consistent <br />with the surrounding area. (The applicant will present elevations or pictures of the <br />proposed building at the public hearing.) <br />d) The proposed use has adequate drainage, water supply, electrical, gas, and sewage <br />treatment facilities. The school site has adequate utilities to serve the temporary <br />classroom buildings. <br />e) The proposed use has adequate road access. The subject property receives direct <br />access from Francesca. The conditional use permit standards require school sites to <br />have their principal entrance from a state highway, county highway, or collector road. <br />While the site does not have direct access to a collector road or county highway, the <br />site is within close proximity of Oneka Lake Boulevard (collector road) and Highway <br />61. Further, the site currently contains a school building, and the six temporary <br />classroom buildings would not significantly increase traffic. <br />If the school district wishes to add a permanent addition in the future, the City would <br />need to examine potential traffic impacts associated with the expansion. <br />f) Technical Evaluation of Floodplain. The school site is not located within a <br />floodplain. <br />g) The proposed use should not increase the potential for flood damage. The proposed <br />use would not increase the potential for flood damage. <br />h) The proposed use will not damage or reduce the benefits the public receives from <br />public waters. The proposed temporary classroom buildings would not damage or <br />reduce the benefits from any public waters. <br />i) The use of watercraft on public waters. The proposed buildings would not involve <br />the use of watercraft. <br />
