Resolution 2001- 74 <br />Page 2 <br />5. A survey of each lot shall be submitted with all building permits for new homes. The <br />survey, in addition to the information required by City ordinances, shall include 1) <br />existing and proposed contours/elevations, 2) significant trees over 12 inches in <br />diameter, and 3) proposed ground cover and/or natural area preservation. <br />6. The applicant shall require at least two tree (minimum diameter of 2.5 inches) in the <br />front yard of each home site. <br />7. The applicant shall attempt to minimize the removal of all significant trees. A <br />significant tree is defined as a tree that is 12 inches or larger in diameter. Significant <br />tree removal for a home, driveway, septic systems, and related improvements shall be <br />permitted if the homeowner can demonstrate that no other feasible option exists. <br />Further, significant tree removal shall be permitted for the proposed road and <br />drainage improvements as shown on the preliminary plat. <br />8. The applicant shall provide a conservation easement over the common open space <br />areas. The conservation easement shall be reviewed and approved by the City <br />Attorney prior to recording. <br />9. The applicant shall provide the City with a copy of the homeowners association <br />documents prior to recording the final plat. The homeowners documents, at a <br />minimum, shall address the following: 1) maintenance of the emergency vehicle <br />access, 2) the common open space areas, 3) restrictions on tree removal and <br />landscaping, and 4) the need to submit a grading plan and tree preservation and <br />landscaping plan with each home site. <br />10. Storm water fees in the amount of $13,068 shall be paid at the time the final plat is <br />recorded. <br />11. Park dedication fees in the amount of $16,200 shall be paid at the time the final plat is <br />recorded. <br />12. The applicant shall disclose, to future buyers, the location of the Bald Eagle <br />Sportsman Club located south of 125x` Street. The disclosure statement shall note <br />that gun noise may be audible from the property. <br />13. The building setback from the south property line on lots 6 and 7 shall be a minimum <br />of 120 feet. <br />14. The centerline radius of 130x` Street shall be a minimum of 300 feet. <br />15. The construction plans are approved subject to final review and approval by the City <br />Engineer. <br />
