Or <br />Resolution 2000-41 <br />Page 2 <br />Minnesota (Minnesota Pollution Control Agency and as updated from time to time), <br />and in compliance with Minnesota Statutes 116.07, subd. 2, and 4. <br />7. Exterior lighting shall be permitted in accordance with Section 6.37. In all instances, <br />however, all lighting shall be directed away from adjacent properties and from public <br />rights-of-way. All lighting shall be turned off by 11:00 PM, except for security <br />lighting. <br />8. The conditional use permit is approved based on the finding that the hoarse training <br />and boarding facilities comply with the standards provided in Section 8.8 c. of the <br />Comprehensive Land Use regulations. More specifically, the City Council finds the <br />following: <br />a. The proposed use is permissible by law. The horse training and boarding facilities <br />are allowed in the Agricultural -zoning district subject to the approval of a conditional <br />use permit. <br />b. The proposed use is keeping with the spirit and intent of the ordinance. The <br />proposed horse training and boarding facilities are consistent with the Agricultural <br />zoning of the property. <br />c. The proposed use is compatible with the City's Comprehensive Plan, and the <br />character of the surrounding area. Horse training and boarding is consistent with the <br />Urban Reserve land use classification of the City's Comprehensive Plan, which is to <br />preserve large tracts of land for possible future urban development. <br />d. The proposed use has adequate drainage, water supply, electrical, gas, and <br />sewage treatment facilities. The existing horse boarding and training facilities are <br />served with a well and septic system, and has adequate drainage. <br />e. The proposed use has adequate road access. The subject property receives direct <br />access off 170' Street North. The horse training and boarding facilities do not <br />generate a significant amount of traffic. <br />f. Technical Evaluation of Floodplain. The proposed horse training and boarding <br />facilities would not be located within the floodplain. <br />g. The proposed use should not increase the potential for flood damage. The <br />proposed use would not obstruct the floodplain or increase the potential for flooding. <br />The horse training and boarding facilities are over 1,000 feet from Hardwood Creek <br />and are located outside of the floodplain. <br />h. The proposed use will not damage or reduce the benefits the public receives from <br />public waters. The proposed operation would not damage or reduce the benefits from <br />any public waters, including Hardwood Creek which runs through the subject <br />
